This sounds bizarre and as always I want more facts.

While this sounds weird there is a line that is shifty about wearing skirts and ‘expectation of privacy’.

I wear flippy little silk skirts in the summer. I have this one skirt that seems to rise up on it’s own in the slightest wind. I know this so if someone snaps a pic at just the right moment I really had no expectation of privacy re that.

However if i am standing in line at Target I do.

I’m with Turnbaby.  How short was this skirt?  If she was flashing underwear every time she reached for something or when she bent over, does she have an expectation that someone wouldn’t take a picture of it?

I agree with Turnbaby 100%. If that skirt were to do a Marilyn Monroe/Seven Year Itch thing well that is unfortunate and embarassing but a peril of wearing a skirt. The fact that he had to stick a camera under her skirt shows this is not one of these situations.

This, along with our friend Sally Kern and the state legislators who praised her, does show that Oklahoma is the biggest dirt hole in the nation - other states may want to turn back the clock and vote in the interest of their prejudices but they don’t. Them Okies shout it from the rooftops!

Don’t you feel left out my asian brothers and sisters. They haven’t forgotten how much fun Japanese internment was - but since you all seem the same to the ignorant Oks your all going. Women, hope you liked to vote while you could. Black people, where do you get the nerves going to white schools? Oh, what, laws? Pish posh. Our judges decide which ones were going to pay attention to.

Can we force Oklahoma to ceceed?

Poppy, I’m totally with you if you want to touch your ass and wear skirts.

This is pretty stupid. Clearly everyone has a right to privacy that extends below their waist. But like Turnbaby said, if she’s outside wearing a short skirt and the wind blows it on up for all to see? Well, whose fault is that?

Still, the crap that OK is talking about? Getting your photo taken in line at Walmart or somewhere? Bullshit.

Today when I was parking my car at work I noticed a woman taking photos with her cell phone of the car next to me that was decked out in Kansas U stickers while the owner of said car was nowhere to be found.  I instantly thought of this post.

I respectfully disagree based only on the information given that this instantly results in a “she asked for it” mentality.

Right or wrong, I think we as a society now see everything as something to photograph, something to capture and pass on as a conversation piece to our friends or family or to the whole world (blog blog blog), since there are so many photo and video gadgets in our possession. 

And, what if the person taking the photo had been a heterosexual woman who intended to email it to her girlfriends with the subject “look at this skanky girl I saw in Target”?

I’m not talking about taking pictures of someone in a skanky skirt.  I have tons of pictures like that from the beach (ohhh Europeans.  You slay me!)

I’m talking about someone slipping a camera underneath someone’s dress.

I am 110% certain some catty woman has slipped her cell underneath a skirt and snapped a photo then sent it to all her friends.

(No, I have not.  But I’m still certain it’s happened.)

I’m not saying it’s right.  I assure you of that.  I’m just saying we have boundary issues when it comes to what is acceptable to photograph, and this could possibly be a case of that.

It could also be a case of the guy being an actual sexual psychopath and those judges just paved the way for him to do much more violating…

Poppy- No, you may no longer go to Oklahoma… however skirt wearing in my presence is encouraged.

Fantastagirl- I agree… especially since the girl was a 16 year old… and apparently this does not constitute him as a sexual predator.

Turnbaby- I understand what your saying about skirts flying up… and I agree that is not necessarily the fault of the witness who happens to be carrying a camera.  I myself would probably be apt to snap myself a souvenier… but skirts rarely fly up in Target stores… nor do witnesses to such incidents have to kneel down behind and stick the camera up said skirt.  Here is another article about it which includes a link to the actual stature that was cited… you know… ‘cause your all lawyer like and stuff.

Avi- I don’t believe that would be the case, since he had to kneel down behind her.

Miss Britt- Yes, it would appear it is… but the Oklahoma legislature is apparently looking to change that.  I guess time will tell whether they’ve truly lost their skulls or not.

An Cailin- It does seem that the state of Oklahoma has been in the news for a bit of backwardness lately.  As for Sunday posts… unlike other former bloggers *COUGH*STEPHANIEDAVIES*COUGH* I encourage people to steal my ideas… I just ask that you make your own graphic and not steal my bandwidth.

Karl- Yeah, they apparently feel that the store is not a place to expect privacy as compared to a restroom or your home.  I’m really surprised that there weren’t assault charges brought forth… but then again assault is defined differently in almost all jurisdictions.

Poppy- The law regarding photography allows for photographs to be taken of things “in public view” which means that if it is in public view… it is photographable.  This however does not include inside department stores.  Those buildings are private property, and anything inside of them that cannot be seen from the public sidewalk outside therefore are not “in public view"… and therefore you need consent to either photograph on the property or to photograph the subject.  The boundaries on the law are pretty clear as to what requires permissions and what doesn’t… and have been on the books for awhile… so why they didn’t charge him with that is beyond me.

A true lady would not purposely show her ass in public and she DOES have a right to a reasonable expectation of privacy UNDER HER OWN CLOTHES. It doesn’t matter where she happens to be, if she put clothes on, she put CLOTHES ON to COVER herself.

An Cailin- Yes… last time I checked copyrighting the days of the week was already done by the Gregorians when they created the calendar.

bluepaintred- I don’t know if it’s considered child porn… but it should be.

Annie- I think there are definitely expectations… and having a camera shoved up your skirt is not one of them.

Lynda- I was shocked that the female judge on the Appellate Court actually agreed with the decision.  It makes me think she doesn’t have anything under the robes worth taking a picture of.
